Unlike the rest of the state, buildings within the boundaries of New York City are not subject to the state’s inspection deadlines. A Periodic Inspection of Parking Structures (PIPS) report is required to be filed with the NYC DOB by August 1, 2024 for all parking garages in Manhattan, Brooklyn, Queens, Staten Island, and the Bronx.
Article 323 of NYC's Local Law 126 has been amended to require an annual observation by a Qualified Parking Structure Inspector (QPSI) starting November 23rd, 2023. The results of such initial observation must be filed with the Department by August 1, 2024.
Please note that the 11/23/23 amendment to the LL126/21 Parking garage Inspection law requires Garage Owners to have a QPSI (engineer) review the garage YEARLY against the Annual Observation Checklist provided by the QPSI for the initial inspection (excerpt below).
Safe: Parking structures filed as Safe require no further action.
Unsafe: Conditions that are hazardous to persons or property and require repair within 90 days from the submission of the compliance report.
Safe with Repairs and/or Engineering Monitoring (SREM): Conditions that are Safe at the time of inspection but are determined to be at risk of developing into Unsafe conditions within the next six years, will be filed as SREM. For each SREM condition, the QPSI must recommend repairs to be made along with a specific repair time frame.

Failure to submit a PIPS report will result in the following penalties which will be retroactive:
• Late Filing: $1000/a month
• Failure to File: $5000/a year
• Failure to correct unsafe conditions: $1000/a month
• Failure to correct srem conditions: $2000 one time
Owners of parking garages including freestanding parking structures, and garages within buildings are required to engage a QPSI to conduct an on-site inspection and evaluation of the parking structure utilizing the DOB's checklist. The purpose of the rule is to identify evidence of deterioration of any structural element, or building component, including any unsafe conditions.
A parking structure inspection, more commonly known as condition assessment, requires a QPSI to review if available: structural design or repair drawings, violations, and FISP reports where applicable, and starting with the second cycle, the most recent compliance report, any available previous reports, and all annual observation checklists for the prior cycle.
The Condition Assessment report shall include the following:
• Evaluation and description of the extent of deterioration, and conditions that cause deterioration that could result in an unsafe condition, or unsafe structure;
• Evaluation and description of the extent of deterioration and conditions that cause deterioration that, in the opinion of the responsible professional engineer, should be remedied immediately to prevent an unsafe condition or unsafe structure;
• Evaluation and description of the unsafe conditions;
• Evaluation and description of the problems associated with the deterioration, conditions that cause deterioration, and unsafe conditions;
• Evaluation and description of the corrective options available, including the recommended timeframe for remedying the deterioration, conditions that cause deterioration, and unsafe conditions;
• Evaluation and description of the risks associated with not addressing the deterioration, conditions that cause deterioration, and unsafe conditions;
• The professional engineer’s recommendation regarding preventative maintenance.
