A parking structure inspection, more commonly known as condition assessment, requires a Qualified Parking Structure Inspector (QPSI) to review if available: structural design or repair drawings, violations, and Façade Inspection and safety Program (FISP) reports where applicable, and starting with the second cycle, the most recent compliance report, any available previous reports, and all annual observation checklists for the prior cycle.

Safe: Parking structures filed as Safe require no further action.

Unsafe: Conditions that are hazardous to persons or property and require repair within 90 days from the submission of the compliance report.

Safe with Repairs and/or Engineering Monitoring (SREM): Conditions that are Safe at the time of inspection but are determined to be at risk of developing into Unsafe conditions within the next six years, will be filed as SREM. For each SREM condition, the QPSI must recommend repairs to be made along with a specific repair time frame.

Repeat offenders may face steeper minimum penalties

  • Late filing: $1,000/month
  • Failure to file a report: $5,000/year
  • Failure to correct unsafe conditions: $1,000/month
  • Failure to correct SREM conditions: $2,000 - one time
  • Serious structural violations: Penalties up to $20,000

Increased Inspection Frequency
Starting January 1, 2028, the inspection cycle frequency will increase from 6 years to 4 years. This means more frequent assessments to ensure ongoing safety.

Stricter SREM Follow-Up Requirements

  • If your garage receives a "Safe with Repairs and/or Engineering Monitoring (SREM)" classification:

  • Follow-up assessments must now occur within 18 and 24 months (reduced from 3 years)

  • An amended report must be filed with the DOB confirming repairs are completed

  • The Annual Observation Report needs to be included with Amended and PIPS reports

Annual observations are required

All NYC parking garages must comply with Local Law 126, including:

  • Private, municipal, and State-owned facilities
  • Freestanding parking structures
  • Garages within buildings (unless parking is a parking lot)

Exemptions: Small garages for one- or two-family houses are exempt.

Which parking garages need to comply?

The Condition Assessment report shall include the following:

• Evaluation and description of the extent of deterioration, and conditions that cause deterioration that could result in an unsafe condition, or unsafe structure;

• Evaluation and description of the extent of deterioration and conditions that cause deterioration that, in the opinion of the responsible professional engineer, should be remedied immediately to prevent an unsafe condition or unsafe structure;

• Evaluation and description of the unsafe conditions;

• Evaluation and description of the problems associated with the deterioration, conditions that cause deterioration, and unsafe conditions;

• Evaluation and description of the corrective options available, including the recommended timeframe for remedying the deterioration, conditions that cause deterioration, and unsafe conditions;

• Evaluation and description of the risks associated with not addressing the deterioration, conditions that cause deterioration, and unsafe conditions;

• The professional engineer’s recommendation regarding preventative maintenance.

Don't forget: Following your initial condition assessment filing, annual observations must be conducted according to the annual observations checklist provided by your QPSI. While these don't need to be filed with the DOB yearly, they must be recorded and made available to the DOB upon request and filed with the Amended Report and PIPS Report.
